Nomiq Terms of Use

1. Agreement
These terms are a contract between you and Nomiq. By creating an account or using the app you accept them. If you do not accept them, do not use Nomiq.
2. Who may use Nomiq
You must be at least 13 years old. You are responsible for your account and for keeping your password secure, and for everything done through your account.
3. Your content
You keep ownership of the places, collections, notes, reviews and photos you add ("your content"). You grant Nomiq a non-exclusive, worldwide, royalty-free licence to store, display and distribute your content solely to operate the app — including showing it to the people you share it with, and to other users when you make a collection public or post a review. This licence ends when you delete the content or your account, except for copies already made by people you shared with and for backups that expire on their normal schedule.
You are responsible for your content. Do not post anything you do not have the right to post.
4. Acceptable use — zero tolerance for objectionable content and abuse
There is no tolerance for objectionable content or abusive users on Nomiq. You agree not to post, share or link content that is: unlawful; harassing, threatening, bullying or hateful towards any person or group; sexually explicit; depicting or promoting violence, self-harm or illegal activity; defamatory; deceptive, including fake reviews and impersonation; infringing on someone else's rights; or spam. You agree not to harass, stalk or abuse other users, and not to misuse the app or attempt to break its security.
Report content or a user by emailing nomiq.team@gmail.com. We review reports and act on ones that violate these terms — normally within 24 hours — by removing the content, and by suspending or terminating the account responsible. We may remove content or terminate an account for a breach of these terms at any time, without notice.
5. Places, maps and third-party content
Place information, maps and links come from Apple Maps, Google Maps, TikTok, Instagram, YouTube and from other users. We do not verify it, and it may be wrong or out of date — check anything that matters, especially opening hours, addresses and accessibility, before you rely on it. Content on those platforms is governed by their terms, not ours.
6. Nomiq Premium
Nomiq is free to use with limits, currently five link or map imports per calendar month, five shared or public collections in total, and no itinerary builder. Nomiq Premium removes those limits.
Premium is an auto-renewing subscription sold through your Apple ID, offered monthly or yearly at the price shown in the app before you buy. Payment is charged to your Apple ID on confirmation of purchase. It renews automatically for the same period unless you cancel at least 24 hours before the current period ends, and your Apple ID is charged for the renewal within 24 hours of the period ending. Manage or cancel your subscription in the App Store: Settings → your name → Subscriptions. Cancelling stops future renewals and Premium stays active until the paid period ends; deleting the app does not cancel it.
Payments and refunds are handled by Apple under Apple's terms — we cannot issue refunds ourselves. We may change prices or what Premium includes, and will tell you before a change affects a renewal.
7. Ending your use
You may stop using Nomiq at any time and delete your account in the app at Profile → Delete Account. We may suspend or terminate your account if you breach these terms, or if we stop operating the service.
8. Disclaimers and liability
Nomiq is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. We do not promise the app will be uninterrupted, error-free, or that saved content will never be lost.
To the fullest extent the law allows, Nomiq is not liable for indirect, incidental or consequential damages, and our total liability for any claim relating to the app is limited to the greater of the amount you paid us in the twelve months before the claim, or ten US dollars. Nothing here excludes liability that cannot lawfully be excluded.
You agree to indemnify Nomiq against claims arising from your content or your breach of these terms.
9. Changes
We may update these terms. The date at the top changes, and for anything significant we will tell you in the app. Continuing to use Nomiq after a change means you accept the updated terms.
10. Apple
You and we acknowledge that:
- These terms are between you and Nomiq only, not with Apple. Nomiq, not Apple, is solely responsible for the app and its content.
- Your licence to use the app is a non-transferable licence to use it on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Nomiq, not Apple, is responsible for addressing any claim by you or a third party relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
- Nomiq, not Apple, is responsible for investigating and defending any third-party claim that the app infringes intellectual property rights.
- You represent that you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
11. Governing law and contact
These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. You and Nomiq submit to the exclusive jurisdiction of the state and federal courts located in California for any dispute not resolved by other means.
